Terms of Service
Last updated 20 October 2026
By creating an account or using Postybuddy, you agree to these terms. Please read them carefully.
About Postybuddy
Postybuddy helps you plan, schedule and publish photos and videos to your Instagram, Facebook and TikTok accounts, on the website postybuddy.com and in the Postybuddy apps. It is run by Anthony Somian, a private individual based in Belgium ("we", "us"), and is currently a free beta (see "Free beta" below). Contact: support@postybuddy.com.
These terms apply to everyone who uses Postybuddy: individuals ("consumers") and businesses. Where a rule differs, it says For consumers or For business customers. How we use personal data is explained in the Privacy Policy. For business customers, the Data Processing Agreement also applies. Both are part of these terms.
Who can use Postybuddy
- You must be 18 or older.
- If you accept these terms for a business, you confirm that you are allowed to bind it; "you" then means that business.
- An account is for one person. Give correct information, keep your password to yourself, and tell us straight away at support@postybuddy.com if you think someone else got into your account. You are responsible for what is done with your account.
- Where Postybuddy offers invites, you can invite people you know; each of them must accept these terms when they sign up. Don't sell or publish invite links.
Connecting Instagram, Facebook and TikTok
- When you connect an account, you allow Postybuddy to publish to it on your behalf, at the times you choose. You can disconnect it at any time.
- Only connect accounts you own or are allowed to manage, for example a client's account with the client's permission.
- Instagram, Facebook and TikTok have their own rules, which you must follow: Instagram Terms of Use, Facebook Terms, TikTok Terms of Service and their community guidelines.
- Those platforms decide what they accept. They can change how their connections work, refuse or remove a post, or limit an account, and we have no control over that. Some platforms may first deliver a post to you as a draft, for you to publish.
Your content
- Your content stays yours. Photos, videos and captions you upload remain your property (or that of whoever licensed them to you).
- You give us only the permission needed to run the service: to store your content, make the technical copies needed to show and publish it, and send it to the platforms you choose, at the times you choose. This permission ends when you delete the content or your account, apart from backups (deleted within 30 days) and posts already published, which you manage on the platforms.
- You confirm that you have the right to publish everything you upload: your own work or work you have a licence for (including music), and the agreement of people who can be recognised in it.
- You are responsible for your content and captions. We don't check content before it is published.
- For business customers: personal data contained in your content is covered by our Data Processing Agreement.
Rules of use
Don't use Postybuddy to:
- store or publish illegal content: for example hate speech, threats, terrorist content, child sexual abuse material, scams, or content that infringes someone's copyright, image or privacy;
- break the rules of Instagram, Facebook or TikTok, for example with spam or fake engagement;
- get into other people's accounts, test or break Postybuddy's security, overload it, or copy it;
- resell or share access to Postybuddy.
If you break these rules, we may remove the content concerned or suspend your account (see "Suspension" below).
Reporting illegal content
Anyone, with or without an account, can report content stored on Postybuddy that they believe is illegal, by writing to abuse@postybuddy.com with:
- where the content is (the account, post or file);
- why you believe it is illegal;
- your name and email address (not required for reports of child sexual abuse material);
- a statement that you believe the report is accurate and complete.
We will confirm receipt, look at the report carefully and without delay, and tell you what we decided. If we remove content or limit an account, we tell the person concerned why, unless the law prevents it, and they can contest the decision by replying to that email. Authorities can use the same address. We handle reports in English.
Free beta
- Postybuddy is free during the beta. It is open to invited testers only. You don't give any payment details, and nothing is charged.
- It is still being built. Features may change, be added or be removed, and there may be bugs or interruptions. Keep your own copies of your photos and videos.
- Paid plans may come later. If they do, we will tell you by email at least 30 days in advance, with the prices and the updated terms, which you will be asked to accept. Paid plans will be offered by a registered business, whose details will then appear in the Legal notice. You will never be charged unless you choose a paid plan yourself.
Availability and support
- We work to keep Postybuddy available at all times, but maintenance, updates or outages at our providers can interrupt it. We announce planned maintenance in advance when we can.
- Support: support@postybuddy.com. We aim to answer within 2 business days.
- Postybuddy itself (its software, design and brand) belongs to us. You may use it under these terms, but not copy, resell or take it apart to build a competing service.
Liability
To the extent the law allows:
- we are not liable for posts that are published late, not published, or refused or removed by a platform, nor for what Instagram, Facebook or TikTok decide about your accounts, unless this is caused by our fault;
- if you are a business customer: we are not liable for indirect losses (such as lost income or profit, followers, opportunities or reputation), and, as Postybuddy is free during the beta, our total liability is limited to €100;
- if you are a consumer: we are liable for damage caused by our fault that could be foreseen when you signed up. We are not liable for damage that could not be foreseen, or that is caused by you or by a platform.
Nothing in these terms limits liability for intentional fault or gross negligence, for harm to life or health, or any right you have under mandatory law, including as a consumer.
You are responsible for damage caused by your content or by breaking these terms, for example if someone claims that a post you published infringes their rights. If you are a business customer and such a claim is made against us, you also cover our reasonable costs of dealing with it, including legal fees.
Suspension, ending the service, deleting your account
- You can stop at any time: delete your account in Postybuddy (app: More → Delete my account; website: Account → Delete my account). You can download your data first.
- We may suspend or close an account that breaks these terms or puts Postybuddy or others at risk. When the problem can be fixed, we first give you a reasonable time to fix it. We tell you why, except where the law or an urgent security risk prevents it, and you can contest our decision by replying.
- We may end the beta or stop offering Postybuddy, with at least 30 days' notice by email, so you can download your data. In an emergency (for example a security problem), we may pause the service sooner.
- After your account is closed, we delete your data as described in the Privacy Policy, except what the law requires us to keep.
Changes to these terms
We may update these terms for a valid reason, such as new or changed features, the start of paid plans, a change in the law, or a change in a platform's rules.
For a change that matters to you, we tell you by email or in Postybuddy at least 30 days before it applies, and ask you to accept the new version at your next login. If you don't agree, you can delete your account before the change applies. The date at the top shows the current version.
Data Processing Agreement (business customers)
If you use Postybuddy for a business, the content you publish and the accounts you connect may contain personal data of other people, such as your customers, staff, or people shown in your photos and videos. We process that data on your behalf, and our Data Processing Agreement applies. It forms part of these terms: by accepting these terms as a business customer, you also accept it. On personal data, the Data Processing Agreement takes precedence over these terms.
Law and disputes
These terms are governed by Belgian law.
- Write to us first at support@postybuddy.com: most problems can be solved that way.
- Business customers: the competent courts of Belgium have exclusive jurisdiction.
- Consumers: you keep the protection of the mandatory law of the EU country where you live, and you may go to the courts of Belgium or of that country. You can also ask the Consumer Mediation Service for help, free of charge.
If part of these terms is found invalid, the rest still applies.
